Charges dismissed against Colby Messer in alleged sexual assault of a woman in Denver

All of the sexual charges against a Vancouver Island man have been dropped today, October 17, 2016.

Colby Messer was accused of the alleged sexual assault of a woman in a Denver hotel room after he and his friends attended a football game in the US city last November.

According to police, the victim had planned to celebrate her birthday and was on her way to a bar with a female friend, when she met Messer and one other person. The victim said the Canadian men bought her drinks, and took her back to the Grand Hyatt Hotel. She did not recall how she arrived at the hotel, nor how she came to be sexually assaulted by the four men.

The victim alleged that the men used a hotel phone receiver, TV remote control and the base of a lamp in the sexual assault.

Messer was charged this passed April with six counts of sexual assault. New information developed in the case leading prosecutors to a determination those charges could no longer be proven in court beyond a reasonable doubt.

The Denver district attorney’s office filed a motion today requesting all charges against Messer be dropped.

Today, a judge agreed and all charges have been dismissed.
